Elvis D. Gonzalez recently dissolved a temporary restraining order that threatened his client's very existence. The case began when an entrepreneur left his former employer, started a competing business, and hired away another employee. After obtaining numerous customers of the previous employer, the new company and the individuals were sued for breaching non-compete agreements. When an e-mail was discovered seemingly indicating that Mr. Gonzalez's clients had improperly solicited customers prior to the termination of their employment, a temporary restraining order (TRO) was entered. The TRO prohibited the new company from signing contracts with any customers that Mr. Gonzalez's clients had contact with while working for the former employer.
Following expedited discovery, Mr. Gonzalez developed substantial evidence that his clients had gone about the setup of the competing business in a completely lawful way. However, a rapidly-approaching, industry-specific deadline for entering into annual service contracts meant that the new company would experience a drastic revenue reduction if the TRO was not lifted. This allowed Mr. Gonzalez to argue that the TRO caused much greater harm to the new company than any possible benefit to the former employer. Even in the face of the non-compete agreement and the damaging e-mail, the judge agreed and dissolved the TRO, ensuring the survival of the new business.
