Elvis D. Gonzalez recently obtained a decision, affirming the entry of a temporary restraining order on appeal. The case began when partners in a Chicago service company decided to go their separate ways. After conducting an investigation of records never previously shared with his client, Mr. Gonzalez developed evidence of widespread financial irregularities by the partner. To make matters worse, as the parties were negotiating the terms of their separation, the partner resigned as an officer, organized a competing business, and began taking key customers with him.
Mr. Gonzalez immediately filed suit seeking, among other things, a temporary restraining order preventing the partner from further competition (the TRO). When the trial court granted Mr. Gonzalez's client the TRO, his partner sought to dissolve it. When Mr. Gonzalez defeated that motion, the partner appealed the decision.
Nevertheless, during expedited appellate proceedings, Mr. Gonzalez persuasively argued that the trial court had not abused its broad discretion in both granting the TRO, and in refusing to dissolve it. The Appellate Court upheld both decisions, and the interests of Mr. Gonzalez's client remained protected.
