Elvis D. Gonzalez recently obtained possession of extensive office equipment that secured obligations owed to his clients. A suit became necessary because another party was holding the equipment to satisfy debts owed to it.
The case began when shareholders in a Chicago litigation support company were granted a security interest in all the assets of a now-defunct Illinois business. Among the assets was a significant amount of office equipment, including computers, furniture, and commerical copiers and scanners. When the business failed, Mr. Gonzalez's clients sought the equipment from the company's former landlord. However, the landlord had different ideas, and was keeping the equipment to satisfy a judgment it had later obtained against the defunct company for unpaid rent. When it refused to relinquish possession, Mr. Gonzalez filed suit.
Mr. Gonzalez's strategy was to expedite the proceedings by holding a preliminary hearing on the parties' respective rights at the outset of the case on five days' notice. The landlord initially resisted and attempted to delay the case, but Mr. Gonzalez persuasively argued that the unique nature of the centuries old remedy of replevin warranted such an expedited hearing. The landlord next argued that it had a superior right of possession in the equipment because the security interest of Mr. Gonzalez's clients was not valid. Nevertheless, following an evidentiary hearing, Mr. Gonzalez defeated this argument as well, and the Court ordered the Sheriff of Cook County to give possession of the equipment to his clients immediately.
